Les Entreprises Dokpam (9427-0097 Quebec Inc.), (“we”, “us” or “Dokpam”, which also includes its affiliates) is also the author and publisher of the www.dokpam.ca domain name and the ‘Dokpam’ mobile application (collectively, “Website”). Web”) and the software and applications provided by Dokpam, including, but not limited to, the “Dokpam” mobile application, and the “Dokpam, Dokplus” branded software and applications (together with the Website, the “Services”).
This privacy policy (“Privacy Policy”) explains how we collect, use, share, disclose and protect the personal information of users of the Services, including Physicians (as defined in the Terms of Use, which can be viewed via the following web link: https:// www.dokpam.ca (the “Terms of Use”), End Users (as defined in the Terms of Use) and visitors to the Website (jointly and severally referred to as “you” or “Users” in this Privacy Policy). We have created this Privacy Policy to demonstrate our commitment to protecting your privacy and personal information. Your use of and access to the Services are subject to this Privacy Policy and our Terms of Use. Any capitalized term used but not defined in this Privacy Policy shall have the meaning ascribed to it in our Terms of Use.
BY USING THE SERVICES OR OTHERWISE PROVIDING US WITH YOUR INFORMATION, YOU WILL BE DEEMED TO HAVE READ, UNDERSTOOD, ACCEPTED AND AGREED TO BE BOUND BY THE PRACTICES AND POLICIES DESCRIBED IN THIS PRIVACY POLICY. – 1. WHY THIS PRIVACY POLICY?
This Privacy Policy is published in accordance with applicable Laws and Regulations;
This Privacy Policy states the following:
i. The type of information collected from users, including Personal Information (as defined in paragraph 2 below) and Sensitive Personal Data or information (as defined in paragraph 2 below) about an individual;
ii. The purpose, means and manner of collection, use, processing, retention and disposal of such information; and
iii. How and to whom Dokpam will disclose such information.
– 2. COLLECTION OF PERSONAL INFORMATION
Certain Services generally require us to know who you are in order to better serve your needs. When you access the Services, or through any interaction with us via e-mail, telephone calls or other correspondence, we may ask you to voluntarily provide us with certain information that personally identifies you or could be used to personally identify you. You hereby consent to the collection of such information by Dokpam. Without limiting the generality of the foregoing, the information we collect from you may include (but is not limited to) the following:
i. Contact information (such as your email address and telephone number)
ii. Demographic information (such as your gender, date of birth and PIN number);
iii. Data regarding your use of the Services and the history of appointments made by or with you in connection with the use of the Services;
iv. Insurance data (such as your insurance company and insurance plan);
v. Other information you voluntarily choose to provide to us (such as information you have shared with us via email or postal mail.
Information collected by Dokpam from you may constitute “Personal Information” or “sensitive personal data or information” under the Regulations.
“Personal Information” is any information relating to a natural person, which, directly or indirectly, in combination with other information available or likely to be available to a legal person, is capable of identifying that person.
“Sensitive Personal Information” is furthermore personal data or information of an individual such as:
vi. passwords;
vii. Financial information such as bank accounts, credit and debit card details or other payment instrument information;
viii. Physical, physiological and mental health status;
ix. Medical records and history;
x. Biometric information;
xi. Information received by a legal entity pursuant to a legal contract or otherwise;
xii. Visitor details provided at the time of registration or subsequently; and
xiii. Call data archives.
Dokpam shall be free to use, collect and disclose information freely available in the public domain without your consent.
3. PRIVACY STATEMENTS
xiv. 3.1 NOTE TO ALL USERS
This section applies to all users.
3.1.1 Accordingly, it is a condition of each User’s use of and access to the Services that they accept the Terms of Use, which also implies acceptance of the terms of this Privacy Policy. Any User who does not accept any of the provisions hereof has the option to immediately discontinue the services provided by Dokpam.
3.1.2 An indicative list of the information that Dokpam may require you to provide to enable your use of the Services is specified in the appendix attached to this Privacy Policy.
3.1.3 Any information provided to Dokpam by a User, including personal information or any sensitive personal data, is voluntary. You understand that Dokpam may use some of your information, which has been designated as Personal Information or “Sensitive Personal Data” (a) for the purpose of providing the Services to you, (b) for commercial purposes and in aggregate or non-personally identifiable form for research, statistical analysis and business intelligence purposes, (c) for sale or transfer of such research data (c) for the sale or transfer of such research, statistical or intelligence data in aggregate or non-personally identifiable form to third parties and affiliates, (d) for communication purposes in order to provide you with a better way to schedule appointments and obtain feedback about the Physicians and their practice, (e) to resolve customer support issues, and (f) for the purpose of contacting you to complete any transaction if you do not complete a transaction after providing us with your contact information in the course of completing the steps that are designed to complete the transaction. Dokpam also reserves the right to use information provided by or about the End User for the following purposes:
i. Publish such information on the Website;
ii. Contacting End Users to offer new products or services;
iii. Contact end users to receive feedback on products and services;
iv. Analyze software usage patterns to improve product design and utility;
v. Analyze anonymized practice information for marketing purposes;
vi. To process payment instructions, including those through independent third party service providers such as payment gateways, banking and financial institutions, prepaid instrument and wallet providers for processing payment transactions or deferring payment facilities.
If you have voluntarily provided your Personal Information to Dokpam for any of the purposes set forth above, you hereby consent to such collection and use of such information by Dokpam. However, Dokpam shall not contact you at your telephone number(s) for any purpose whatsoever, including those referred to in this Section 4.1 (iii), if such telephone number(s) is (are) listed in the Do Not Call Registry without your express, clear and unambiguous written consent.
3.1.4 The collection, use and disclosure of information that has been designated as Personal Information or Sensitive Personal Data requires your express consent. By affirming your consent to this Privacy Policy, you are giving your consent to such use, collection and disclosure as required by applicable law.
3.1.5 Dokpam does not control or endorse the content, messages or information found on the Services and, therefore, Dokpam specifically disclaims any liability with respect to the Services and any actions resulting from your participation in the Services, and you agree to waive any claims against Dokpam relating thereto, and to the extent that such waiver may be ineffective, you agree to release any claims against Dokpam relating thereto.
3.1.6 You are responsible for maintaining the accuracy of the information you submit to us, such as your contact information provided as part of the Account registration. If your personal information changes, you may correct, delete inaccuracies or amend the information by making the change on our member information page or by contacting us via email. We will make a good faith effort to make the requested changes to our then active databases as soon as reasonably possible. If you provide information that is untrue, inaccurate, not current or incomplete (or becomes untrue, inaccurate, not current or incomplete), or Dokpam has reasonable grounds to suspect that information provided by you is untrue, inaccurate, not current or incomplete, Dokpam may, in its sole discretion, discontinue providing the Services to you. There may be circumstances in which Dokpam will not correct, delete or update your Personal Data, including (a) where the Personal Data is opinion data that is retained solely for evaluation purposes; and (b) the Personal Data is in documents related to a lawsuit if all proceedings related to the lawsuit have not been completed.
3.1.7 If you wish to cancel your account or request that we no longer use your information to provide services to you, contact us via support@Dokpam.ca. We will retain your information for as long as your account with the Services is active and as needed to provide the Services to you. We will not retain such information longer than is necessary for the purposes for which the information may be lawfully used or is otherwise required by any other law at the time. After a period of time, your data may be anonymized and aggregated, and then may be retained by us for as long as necessary for us to provide our Services effectively, but our use of the anonymized data will be for analytical purposes only. Please note that your withdrawal of consent or cancellation of your Account may prevent Dokpam from providing its Services to you or terminate any existing relationship Dokpam may have with you.
3.1.8 If you wish to opt out of receiving non-essential communications such as promotional and advertising information regarding the Services, please email us at support@Dokpam.ca.
3.1.9 Dokpam may require the User to pay by credit card, bank transfer, debit card or cheque for the Services for which the subscription amount(s) is/are payable. Dokpam will collect such User’s credit card number and/or other financial institution information such as bank account numbers and will use such information for billing and payment processes, including, but not limited to, using and disclosing such credit card number and information to third parties as necessary to complete such billing transaction. Verification of credit information, however, is performed solely by the user through the authentication process. The User’s credit/debit card details are processed on secure sites of approved payment gateways that are digitally encrypted, thus providing the highest degree of care possible under current technology. However, Dokpam offers you the option of not storing your payment information. However, the User is advised that Internet technology is not completely secure and that the User should exercise discretion in its use.
3.1.10 Due to Internet communication standards, when a User or End User visits the Website, Dokpam automatically receives the URL of the site from which that person is visiting. Dokpam also receives the Internet Protocol (IP) address of each user’s computer (or the proxy server a user uses to access the World Wide Web), the operating system of the user’s computer and the type of Web browser the user uses, e-mail patterns, and the name of the user’s ISP. This information is used to analyze general trends to help Dokpam improve its service. The link between the User’s IP address and the User’s personally identifiable information is not shared or disclosed to third parties. Notwithstanding the foregoing, Dokpam may share and/or disclose some of the aggregate findings (not specific data) in anonymous (i.e., non-personally identifiable) form with advertisers, sponsors, investors, strategic partners and others to help grow its business.
3.1.11 The Website uses temporary cookies to store certain information (which is not sensitive personal data or information) that is used by Dokpam and its Service Providers for technical administration of the Website, research and development and for user administration. In the course of serving advertisements or optimizing services to its users, Dokpam may allow authorized third parties to place or recognize a unique cookie on the user’s browser. However, cookies do not store any Personal Information about the User. You can adjust your Internet browser to disable cookies. If cookies are disabled, you can still use the Website, but the Website may be limited in the use of certain features.
3.1.12 A user may have limited access to the website without creating an account. Non-registered users can make appointments with doctors by providing their name and phone number. In order to access all the features and benefits of our website, a user must first create an account on our website. To create an account, a user is required to provide the following information, which such user expressly acknowledges is Personal Information that allows others, including Dokpam, to identify the user: name, user ID, email address, country, zip code, age, phone number, password chosen by the user and valid financial account information. Other information requested on the registration page, including the ability to receive promotional offers from Dokpam, is optional. Dokpam may, in the future, include other optional information requests from the User to help Dokpam customize the Website to provide personalized information to the User.
3.1.13 This Privacy Policy applies to the Services that are owned and operated by Dokpam. Dokpam has no control over sites displayed as search results or links from its Services. These other sites may place their own cookies or other files on users’ computers, collect data or solicit personal information from users, for which Dokpam is not responsible. Accordingly, Dokpam makes no representations regarding the privacy practices or policies of such third parties or the terms of use of such Web sites, nor does Dokpam guarantee the accuracy, integrity or quality of any information, data, text, software, sound, photographs, graphics, video, messages or other materials available on such Web sites. Inclusion or exclusion does not imply any endorsement by Dokpam of the Web site, the Web site provider or the information on the Web site. If you decide to visit any third-party Web site linked to the Web Site, you do so entirely at your own risk. Dokpam encourages the User to read the privacy policies of that website.
3.1.14 The Website may allow the User to communicate with other users or post information that other users may access, whereupon other users may collect such data. Such users, including moderators or administrators, are not authorized representatives or agents of Dokpam, and their opinions or statements do not necessarily reflect those of Dokpam, nor are they authorized to bind Dokpam to any contract. Dokpam hereby expressly disclaims any and all liability for any reliance on or misuse of such information that is made available by users or visitors in this manner.
3.1.15 Dokpam does not collect information about visitors to the Website from other sources, such as public records or agencies, or private organizations, except for the purpose of user registration (the collection, use, storage and disclosure of which each End User must agree to in order for Dokpam to effectively perform the Services).
3.1.16 Dokpam maintains a strict “no spam” policy, which means that Dokpam does not intend to sell, rent or otherwise give your email address to any third party without your consent.
3.1.17 Dokpam has implemented international market best practice and security policies, rules and technical measures to protect Personal Data under its control from unauthorized access, improper use or disclosure, unauthorized modification and unlawful destruction or accidental loss. However, for any loss or theft of data due to unauthorized access to the User’s electronic devices through which the User uses the Services, Dokpam shall not be liable for any loss suffered by the User.
3.1.18 Dokpam implements reasonable security practices and procedures and has a comprehensive documented information security program and information security policies containing managerial, technical, operational and physical security controls commensurate with the information collected and the nature of Dokpam’s business.
3.1. 19 Dokpam takes your right to privacy very seriously and, except as specifically set forth in this Privacy Policy, will only disclose your Personal Information if required to do so by law, rule, regulation, law enforcement, government official legal authority or similar requirement, or when Dokpam, in its sole discretion, deems it necessary to protect its rights or the rights of others, to prevent harm to persons or property, to combat fraud and credit risk, or to enforce or apply the Terms of Use.
xv. 3.2 NOTE TO PHYSICIANS:
This section applies to all physicians.
3.2.1 As part of the registration and application creation and submission process available to Physicians on Dokpam, certain information, including sensitive personal information or data, is collected from Physicians.
3.2.2 All statements in this Privacy Policy apply to all Physicians who are therefore required to read and understand the privacy statements set forth herein before submitting Personal Information or Sensitive Personal Data or Information to Dokpam, failing which they are required to leave the Services, including the Website immediately.
3.2.3 Physicians’ Personal Information, which they choose to provide to Dokpam, is used to help Physicians describe and identify themselves. You are the owner of your information and you consent to Dokpam’s collection, use, processing and/or disclosure of it for the purposes set out below. Dokpam may use this information for commercial purposes and in aggregate or non-personally identifiable form for research, statistical analysis and business intelligence purposes, and may sell or otherwise transfer such research, statistical or intelligence data in aggregate or non-personally identifiable form to third parties and affiliates. Dokpam also reserves the right to use information provided by or about Physicians for the following purposes:
i. Publish this information on the website;
ii. Contact physicians to offer new products or services subject to the telephone number registered on the national do not call list;
iii. Contact physicians to collect product feedback;
iv. Analyze software usage patterns to improve product design and utility;
v. Analyze anonymized practice information, including financial and inventory information for marketing purposes.
3.2.4 Dokpam automatically activates the listing of physician information on its website for each “physician” or “clinic” added to a practice using its software. Information relating to the physicians listed on the Website is displayed when End Users search for physicians on the Website, and such information is used by End Users to request appointments with the physician. The personal information of the physicians listed on the Website is not generated by Dokpam but is provided to Dokpam by physicians who wish to register on the Website, or is collected by Dokpam from the public domain. Dokpam posts this information on its website as is, without any representation or warranty as to its accuracy or completeness. We strongly encourage physicians to check the accuracy and completeness of their information from time to time, and to notify us immediately of any discrepancies, changes or updates to such information. Dokpam will, however, take reasonable steps to ensure the accuracy and completeness of such information.
3.2.5 Dokpam may also post information for physicians who have not registered for the Services, provided that they have consented to Dokpam collecting, processing and/or disclosing their information on the Website. These physicians are verified by Dokpam or its associates, and Dokpam makes every effort to capture accurate information for these physicians. However, Dokpam assumes no responsibility for any incorrect or incomplete information appearing on the Website.
xvi. 3.3 NOTE TO END USERS:
This section applies to all End Users.
3.3.1 As part of the registration or application creation and submission process made available to End Users on this website, certain information, including personal information or sensitive personal data is collected from End Users.
3.3.2 All statements in this Privacy Policy apply to all End Users who are therefore required to read and understand the privacy statements set forth herein before submitting any Personal Information or Sensitive Personal Data to Dokpam, failing which they are required to leave Dokpam immediately.
3.3.3 If you have inadvertently submitted such information to Dokpam prior to reading the privacy statements set forth herein, and you do not agree with the manner in which such information is collected, processed, stored, used or disclosed, you may access, modify and delete such information using the options provided on the Website. In addition, you may, by sending an email to privacy@Dokpam.ca, ask whether Dokpam is in possession of your Personal Information, and you may also request that Dokpam delete and destroy all such information.
3.3.4 Personal information that End Users choose to provide on the Website is used to help describe or identify themselves. Other information that does not personally identify End Users as individuals is collected by Dokpam from End Users (such as the usage patterns described above) and is the sole property of Dokpam. Dokpam may also use this information in an aggregated or unaggregated form for research, statistical analysis and business intelligence purposes, and may sell or otherwise transfer such research, statistical or intelligence data in an aggregated or unaggregated form to third parties and affiliates. In particular, Dokpam reserves the right to use Anonymous End User Demographic Information and Anonymous End User Health Information for the following purposes:
i. To analyze software usage patterns to improve product design and utility.
ii. To analyze such information for research and development of new technologies.
iii. Use the analysis of this information in other Dokpam commercial product offerings.
iv. Share the analysis of such information with third parties for marketing purposes.
3.3.5 Dokpam will communicate with End Users by email, telephone and notices posted on the Website or by other means available through the Service, including text and other forms of messaging. End Users may change their messaging and contact preferences at any time by logging into their “account” at www.Dokpam.ca and changing the account settings.
3.3.6 Dokpam occasionally conducts a user survey to collect information about End User preferences. These surveys are optional and if End Users choose to respond, their responses will remain anonymous. Similarly, Dokpam may offer contests to eligible End Users in which we ask for contact and demographic information such as name, email and postal address. The demographic information that Dokpam collects during the registration process and through surveys is used to help Dokpam improve its services to meet the needs and preferences of End Users.
3.3.7 Dokpam may retain records of electronic communications and telephone calls received and made for appointment setting or other purposes for service administration, customer support, research and development and for better physician rostering.
3.3.8 All Dokpam employees and contractors who have access to and are associated with the processing of sensitive data or information are required to respect the confidentiality of each End User’s personal information or sensitive personal data and information. Dokpam has implemented procedures and technologies consistent with industry best practices and in accordance with applicable laws to maintain the security of all Personal Data from the point of collection to the point of destruction. Any third party data processor to whom Dokpam transfers Personal Data will be required to agree to comply with these procedures and policies, or to implement appropriate measures itself.
3.3.9 Dokpam may also disclose or transfer End User Personal and other information provided by a User to a third party in connection with a reorganization or sale of the assets of a division or company of Dokpam. Any third party to whom Dokpam transfers or sells its assets will have the right to continue to use the personal and other information that End Users provide to us in accordance with the Terms of Use.
3.3.10 To the extent necessary to provide the Services to End Users, Dokpam may share their Personal Information with third party contractors who work on behalf of or with Dokpam to provide End Users with such Services, to assist Dokpam in communicating with End Users or in maintaining the Website or independent third party service providers to process payment instructions, including providing a deferred payment facility to End Users in connection with the Services. These third party service providers have access to the information necessary to process payments, but may not use it for any other purpose. Generally, these contractors have no independent right to share such information, but certain contractors that provide services on the Website, including online communication service providers, may use and disclose personal information collected in the course of providing those services in accordance with their own privacy policies. In such circumstances, you consent to our disclosure of your personal information to such contractors solely for the purposes intended.
xvii. 3.4 NOTE TO CASUAL VISITORS :
3.4.1 No sensitive personal data or information is automatically collected by Dokpam from casual visitors to this Website who simply browse the Website.
3.4.2 Nevertheless, certain provisions of this Privacy Policy are applicable even to such casual visitors who are also required to read and understand the privacy statements set forth herein or else leave this Website immediately.
3.4.3 If you, as a casual visitor, have inadvertently browsed another page of this Website before reading the privacy statements set forth herein, and you do not agree with the manner in which such information is obtained, collected, processed, stored, used, disclosed or retained, simply exiting that browser application should normally delete any temporary cookies set by Dokpam. All visitors, however, are encouraged to use the “delete cookies” feature of their browsers to ensure such deletion, as Dokpam cannot guarantee, predict or foresee the behavior of the equipment of all visitors to the Website.
3.4.4 You are not a casual visitor if you have voluntarily submitted personal data or information to Dokpam by any means, including e-mail, mail or via the registration process on the Website. All such visitors will be deemed to be and will be treated as users for the purposes of this Privacy Policy, and in that event, all statements in this Privacy Policy apply to such persons.
4. PRIVACY AND SECURITY
xviii. 4.1 Your Personal Information is maintained by Dokpam in electronic form on its own equipment and that of its employees. This information may also be converted to physical form from time to time. Dokpam takes every precaution to protect your Personal Information both online and offline and implements reasonable security practices and measures, including certain managerial, technical, operational and physical security controls that are commensurate with the information collected and the nature of Dokpam’s business.
xix. 4.2 No Dokpam administrator will have knowledge of your password. It is important that you protect yourself from unauthorized access to your password, computer and cell phone. Be sure to log out of the website when you are finished. Dokpam is not responsible for any unauthorized use of your account and password. If you suspect any unauthorized use of your account, you must immediately notify Dokpam by sending an email to support@Dokpam.ca. You will be liable to indemnify Dokpam for any loss that Dokpam suffers as a result of such unauthorized use of your account and password.
xx. 4.3 Dokpam makes all User information available to its employees, agents or partners and to third parties only on a need-to-know basis, and commits only its employees to strict confidentiality obligations.
xxi. 4.4 Part of Dokpam’s functionality is to assist physicians in maintaining and organizing such information. Dokpam may therefore maintain and submit all such records to the appropriate authorities or to physicians who request access to such information.
xxii. 4.5 Part of Dokpam’s functionality is to assist patients in accessing information about themselves. Dokpam can therefore maintain and submit all such records to the relevant patients or their physicians.
xxiii. 4.6 Notwithstanding the foregoing, Dokpam is not responsible for the privacy, security or distribution of your Personal Information by our partners and third parties outside the scope of our agreement with such partners and third parties. In addition, Dokpam will not be responsible for any breach of security or actions of third parties or events beyond Dokpam’s reasonable control, including, but not limited to, acts of government, hacking, unauthorized access to computer data and storage, device, computer failure, breach of security and encryption, poor Internet service or poor telephone service to the User.
– 5. CHANGES TO THE PRIVACY POLICY
Dokpam may update this Privacy Policy at any time, with or without notice. In the event that there are material changes in the way Dokpam handles User Personal Information, or in the Privacy Policy itself, Dokpam will post a notice on the Website or send Users an email, as provided above, so that you may review the changes, terms and conditions before continuing to use the Services. As always, if you object to any of the changes in our Terms and no longer wish to use the Services, you may contact support@Dokpam.ca to deactivate your account. Unless otherwise specified, Dokpam’s current privacy policy applies to all information it has about you and your account.
If a user uses the Services or accesses the Website after notice of a change has been sent to that user or posted on the Website, that user hereby consents to the changed terms.
– 6. PRIVACY FOR MINORS
Dokpam strongly encourages parents and guardians to supervise the online activities of their minor children and to consider using parental control tools available from online services and software manufacturers to help provide a child-friendly online environment. These tools can also prevent minors from disclosing their name, address and other personal information online without parental permission. Although the Dokpam Website and Services are not intended for use by minors, Dokpam respects the privacy of minors who may inadvertently use the Internet or the Mobile Application.
– 7.CONSENT TO THIS POLICY
You acknowledge that this Privacy Policy is part of the Terms of Use of the Website and other Services, and you unconditionally agree that becoming a user of the Website and its Services signifies your (i) consent to this Privacy Policy, and (ii) consent to Dokpam’s use, collection, processing and/or disclosure of your Personal Information in the manner and for the purposes set forth in this Privacy Policy. Your visit to the Website and use of the Services is subject to this Privacy Policy and the Terms of Use.

We will use reasonable efforts to respond promptly to any requests, questions or concerns you may have regarding our use of your personal information. – 1. end users using the website by creating an account on this website or the “Dokpam” mobile application:
You may create an account by providing us with information regarding your [name, cell phone number, email address] and any other information requested on the end user registration page. This allows us to provide you with the ability to use the account to book your appointments and store other health-related information.
– 2. End Users using the Website without registering for an account on the “Dokpam” website or mobile application (i.e., the “Guest” End User):
You may use the Website without registering for an account, but in order to schedule an appointment, you may be asked for certain information (including your [cell phone number], and any other information requested when you choose to use the Services without registration) to confirm the appointment.
– 3. Physician using the free registration service on the “Dokpam” website or mobile app by signing up for an account:
As a physician, you may be required to provide us with information regarding your [name, cell phone number, email address], and any other information requested on the physician registration page to create an account. Dokpam may send email and/or SMS confirmations or other communications to End Users in connection with their bookings, appointments, or other interactions with you, if such interactions have been facilitated by Dokpam.
– 4. Physician using the free registration service on the “Dokpam” website or mobile app without registering for an account:
As a physician, you may take advantage of the registration service without registering for an account by providing information regarding your [name, cell phone number, email address], and any other information requested by any of Dokpam’s employees or agents who contact you in person or by phone. In such event, Dokpam will retain such information if and until you choose to create an Account, for which Dokpam may contact you from time to time. Dokpam, once it has collected this information from you, will send you a confirmation email confirming the information provided and that you will be listed on the Website. In the event that you do not wish to be so listed on the Website, please notify Dokpam immediately at support@Dokpam.ca
